Mini bike as a moped, could it be legal?

If I had a mini bike (pocket rocket) that was under 50cc and a two stroke engine, if I added a horn, headlight, taillight, turn signals, DOT tires, and I had a title to it and it met exhaust sound regulations could I register it as a moped? South Carolina.

By definition, in South Carolina, a moped is defined: “According to state law, a “moped” means a cycle with pedals to permit propulsion by human power or without pedals and with a motor of not more than 50 cubic centimeters, with not more than two brake horsepower and which can’t go over 30 miles an hour on level ground. If an internal combustion engine is used, the moped must have a power drive system that functions directly or automatically without clutching or shifting by the operator after the drive system is engaged.”

In California, a moped MUST have a pedal propulsion system (you must be able to pedal it as a bike) in order for it to qualify as a moped. I do not see that regulation in the SC vehicle code.
