How strict are police officers in MILWAUKEE, WI when enforcing knife laws?
I carry a 3″ (exactly) Spyderco Persistence with me on a daily basis. I’ve never had any problems carrying it, and I generally don’t take it out in public unless I’m opening something or something of that nature.
I understand that it is completely LEGAL to carry the knife I have and how I carry it (unconcealed) according to Wisconsin Law. Now, I’m trying to stereotype all police officers, but I’m sure that I would be arrested regardless of whether or not I’m following the law. Just looking for some thoughts on this.

If you carry a legal knife, and are arrested anyway, the officer making the arrest is liable under FEDERAL law 42 U.S.C. § 1983. While officers normally enjoy protection from suit called “qualified immunity,” that immunity is null and void if they make an arrest without any cause or an arrest for something that is not a crime. In MD we had a case a few years back of this exact subject: Cop arrested a guy for a legal knife. Prosecutor dropped charges because it was a non-crime. Cop was tried and convicted under 42 U.S.C. § 1983, and the conviction upheld on appeal. Reasoning was that, as a cop, he should have know the knife laws of his own state.
Again, even though that was in MD, 42 U.S.C. § 1983 is a federal law and applies to the entire US.
